Please Note: PhotoRestore operates as a standalone photo restore platform built on advanced artificial intelligence. No AI model provider affiliates with, endorses, or sponsors us in any way. The restore services we deliver run entirely on our own AI technology and interfaces.

Introduction and Acceptance of Terms

PhotoRestore is an AI-driven photo restore service that uses modern artificial intelligence to revive the memories that matter to you. The moment you access or use the service, you accept these Terms of Service in full. Should any part of these terms be unacceptable to you, we ask that you refrain from using the service.

Use of the Service

Through PhotoRestore, you gain access to a sophisticated AI platform that repairs, sharpens, and adds color to photos that are aged, damaged, or of poor quality. In using it, you commit to complying with every applicable law and regulation, whether local, state, national, or international.

User Accounts and Registration

1. Creating an Account: A number of the service's features require a registered account. When you sign up, the details you supply must be truthful and complete.

2. Keeping Your Account Secure: Safeguarding your login credentials is your responsibility, and you remain accountable for everything that happens under your account.

3. Your Obligations: If you become aware that someone has used your account without permission, or of any other security lapse, you must let us know right away.

Content and Intellectual Property Rights

Everything PhotoRestore makes available to you — the AI restore technology, the platform's features, and its documentation among other things — falls under copyright protection.

• The AI technology and intellectual property that power PhotoRestore are not yours; using the service grants you no ownership of them.
• The photos you upload and the restored versions our service produces remain entirely yours.
• Depending on the subscription or usage plan you hold, the restored photos may be used for either personal or commercial purposes.
• Reselling or redistributing our AI restore technology or the service itself is not permitted.

Prohibited Activities

When using PhotoRestore, you must not do any of the following:

• Gain unauthorized access to, or attempt to reverse engineer, our proprietary AI restore technology and algorithms
• Resell or redistribute the service or any restored content in a way that breaches usage rights
• Interfere with, or otherwise disrupt, the security or performance of the service
• Use the service to restore content that is illegal, harmful, or otherwise inappropriate
• Upload, process, or generate NSFW, sexually explicit, sexually suggestive, or pornographic material of any kind — including, without limitation, nudity, sexual acts, or anything meant to sexualize a person. Content of this nature will be taken down at once and may lead to termination of your account with no refund.
• Try to circumvent any security feature, usage limit, or content filter
• Restore content that violates the intellectual property rights of others
• Turn restored images into deepfakes, face-swaps, manipulated faces, or other deceptive material without clearly disclosing it
• Use the service to create, restore, or enhance depictions of violence, gore, or self-harm, or anything that encourages hatred or discrimination

User-Generated Content (Story Gallery)

Our Gallery feature lets users tell the story of how their photo restoration went. Submitting a story means you accept the following:

Content Ownership and License

• The text and images you submit stay under your ownership.
• Submitting a story gives PhotoRestore a non-exclusive, worldwide, royalty-free license to show, share, and promote that story and its images across our platform and marketing channels.
• You confirm and guarantee that you are entitled to share everything you submit, including any photos in which individuals can be identified.

Prohibited Content

Stories you submit must never include:

• Sexually explicit, pornographic, or NSFW material
• Anything that encourages violence, hatred, discrimination, or unlawful activity
• Material that violates the intellectual property or privacy rights of others
• Content that is false, misleading, or defamatory
• Spam, advertisements, or promotional material with no connection to photo restoration

Content Moderation and Removal

• Every story we receive goes through both automated and human review.
• At our sole discretion, and without giving notice or a reason beforehand, we may decline, delete, or unpublish any story.
• Suspension or termination of an account may follow repeated violations.

User Responsibility and Liability

• The content you submit is your responsibility alone. PhotoRestore bears no liability for anything users post.
• Where content you submit breaks any law or regulation, the full legal responsibility for that breach rests with you.
• You agree to indemnify PhotoRestore against any claim, damage, or legal action that stems from the content you submit.

Rewards Program

• Each month, PhotoRestore may pick standout stories to reward with free credits. This selection is entirely at our discretion and creates no obligation on our part.
• The terms of the rewards may change at any time without notice.

Privacy and Data Collection

The categories of data PhotoRestore gathers are:

• Account Information: Details you supply when setting up an account
• Usage Details: Information about how you use our photo restore features
• Device Information: Details about the device through which you reach our service
• Cookies: Data used to make your experience with the service better
• Payment and Billing Information: Details we need in order to process payments
• Photos and Restore Content: The photos you upload, along with restore instructions, kept only for processing

A Key Privacy Commitment: Your uploaded photos and restore instructions are never used to train AI models. They serve only to fulfill your restore requests and are not held long-term for any training purpose.

Pricing and Payments

• Quality service is our priority. If the service falls short of your expectations, reach out to us so we can work toward a solution
• Every customer support request will receive a reply from us within 3 business days
• Where service quality is at issue, refunds may be granted at our discretion
• Outside of the cases above, all purchases are final, except where the law requires otherwise
• Prices may change, and we will let users know when they do
• You agree to cover every charge tied to the plan you choose
• The payment terms depend on the plan and payment method you select

Free Trial and First Restore

• The full set of Pro features comes free with your very first photo restore
• This gives you a chance to see everything our AI restore technology can do
• Once the free trial ends, you can keep using the basic features or move to a paid plan for unlimited access

Termination

At our sole discretion and without prior notice, we may end or suspend your access to the service if we consider your conduct to be in breach of these Terms or harmful to other users, to us, or to any third party.

Disclaimer of Warranties

We offer the service on an "as is" and "as available" basis. We give no warranty or representation regarding how accurate, reliable, or available the service is, and we disclaim every warranty to the greatest extent the law allows. We work hard to deliver high-quality photo restore, yet the outcome can differ depending on the state and quality of the photo you start with.

Limitation of Liability

So far as the law permits, PhotoRestore will not be held liable for any damages — direct, indirect, incidental, special, consequential, or punitive — that result from your use of, or inability to use, the service.

Indemnification

You agree to defend and hold harmless PhotoRestore, along with its affiliates and their respective officers, directors, employees, and agents, from every claim, damage, loss, liability, and expense (attorneys' fees included) that arises out of your use of the service, the restored content, or any breach of these Terms.

Governing Law and Dispute Resolution

Applicable law governs and shapes the interpretation of these Terms, setting aside any conflict-of-law rules. Should a dispute arise out of these Terms or the service, it will be settled by binding arbitration under the applicable law.

Changes to These Terms
